I filed a police report, but am still undecided whether to press
charges, since I didn't get hurt. But what do you do when somone
attacks you to try and win an argument.
I was attempting to warranty a pair of Endura waterproof pants that
didn't turn out to be very waterproof. The seam taping has cracks in
it that do a magnificent job of funneling water directly above my
knees, soaking my pants. Since I only wore them twice, they look fine
on the outside. The employee Paul (he told me he was the manager)
decided that I was asking too much of a pair of pants and wouldn't
warranty them. I of course, started to get irate that I spent $130 on
a pair of pants that don't do what a $20 pair does. Since I obviously
wanted somthing he wasn't about to give me, he deiced to end the
discussion. Within 30 seconds it went from "You're going to have to
leave" to assault. He called for help, rushed me, hit me, then thought
better of it, and then pushed and wrestled me to the door. Since I was
still arguing my dissatifaction with the pants, I wasn't really
resisting, and no one was seriously hurt. But I was still attacked
because Paul didn't want to accept the fact that these rainpants leave
my thighs itchy after a little ride in the rain.
Anybody know who this guy might be? Anyone know how to get in touch with the owner of the shop? |

that is juicy! Glad you're okay, You should ask for an apology and your money back - at the very least.
If you are really pissed you should take it to the people - email the shift list, the mercury, wweek with your story. Turning it into a PR nightmare is way more effective than dealing with the cops.
Go even further, check out http://www.consumerist.com/ they eat stories like this up and have a huge national readership. Wow, Now that's what I call corporate loyalty. Did you get his name? Was he the manager/assistant/clerk. What time and day did this happen? Do they have in store security cameras? Could they identify forty people on minis riding through their store? okay got the phonebook....that number, the oh so magicial number to dial and lodge many a harrassing call is 503-736-1074. I'm totally fine. I was too busy trying to take his picture with my
cell phone for things to get violent. It would have been a sweet shot, but it just takes too long to load and focus.

good social hack on the email address
I wrote a strongly worded email to the recepient
(don't mess with me or I'll write a strongly worded email to you too punk!)
if my post was ambiguous the point is that this is assault and battery
make sure there's a police record and yeah you could sue
the apartment manager of my building got drunk one night and did the same
he was fired in less than a day and I got a lawyer to sue the property management company to pay for my moving out (the manager was hanging around the building afterwards and approached me on one occassion after the incident)
unfortunately all I could afford was the threat of sueing and not an acutal lawsuit so they called my bluff and I got nothin but a few hundred dollar lawyer bill
so yes, it is absolutely assault and battery, but unless you have money to sue there's not much you can do but get the dude fired and for godsakes get a fuckin refund and apology from the store owner
that or find out when this creep is working next and the zoocrew will roll up on his punk ass |

I have some Burley rain pants that never leak. I have also bought a 40 dollar rain suit and had it not leak until I split the crotch after about 3 years of beating on. Wow! If everything your saying is true then I say we launch an all out PR war on all Bike N Hikes. I have purchased 2 bikes and a lot of parts there and if this is how they act on a return I can shop at Bike Gallery or online at DansComp.com
I personally do not know Paul and have only had good experiences in the shop but will quit going there if this is true.

both have very different feelings and versions of the story.
without being there, it is hard to really know what happened. I think both sides sincerely believe they were in the right.

After talking with the owner Keving Chudy, and hearing that he considers Paul to be in the right to attack a customer, I am more surprised than ever.
It turns out that Kevin Chudy was present in the store at the time, which is funny because he is the one I wanted to talk to when Paul became belligerent. It was in fact my insistence to talk to the owner that caused Paul to physically assault me. Kevin's story that I was some sort of threat is a complete lie, and these guys are going to back each other up in order to try and come out clean. Kevin wasn't involved, and probably didn't see anything, so it is only Paul's statements, and since he is the one who provoked the incident, of course he is going to lie to protect himself.
I'm currently communicating with the police, so stand by. |

When I was 12 I got hit by a car on the highway. I broke 7 bones and spent 8 days in the hospital but somehow my bike looked worse than me afterwards. It was a total loss bent frame, taco'd wheels etc...the car probably ran over it. The owner of bike and hike called my parents up before I was even out of the hospital and quietly gave me a brand new bike because he had heard that mine was destroyed. Who knows if I even would have gotten back on a bike if I hadn't had one to ride while I still had my casts on. I don't personally know the owner of bike and hike, in fact I never met him, but he isn't all bad and I hope that given some time and perhaps some concessions from both sides this will be resolved.

| I'd have to say that the owner of the shop has been very reasonable in the past, and it was actually Paul who assaulted me. This guy took it upon himself to attack me rather than deal with the argument in a civil way. I don't see any reason to condemn the entire shop, except for the fact that Kevin threatened to sue me when I spoke with him on the phone, and said he was standing by his employee. |

I have never personally liked the way BNH has treated me when I come in, with the "can I take your bag" or "can I help you with something" from everyone. The lack of anything noticably created by our talented local bike enthusiasts andthe pretty jacked up prices don't help. "Have a good day, and thanks for shopping at Wal-bike" is what I hear when I leave, not having purchased anything, and feeling awkward that a bike store would follow me from aisle to aisle just because I don't look like one of there spandex warrior shoppers with $5000 track bikes who throw their bike on a car to get where they want to cycle for a few miles, and then lose interest and toss that bike in storage, never to be seen again. _________________ A merry heart goes all the way,

Not to stick my nose in, but I'm a little familiar with this stuff.
It sounds like the only reason that this guy is sticking by his employee is because he has to - under Agency and Tort law, he would be just as on the hook as ole' punchy there.
Also, I would be curious what he is threatening to sue you with, unless he has an imaginary court system where truth isn't a defense to slander or any of its brethren 95% of the time.
